General Terms and Conditions of Sale

1. Object

1.1 These General Conditions, updated in May 2020, are intended, with the order form, and the other elements referred to in regulating the terms and conditions governing the provision of the Online Store Service of Garrafeira Gato Preto (Wine Hour, Lda), based at Avenida João Franco, nº 308 - 5050-226 Peso da Régua, under the number registration and identification number of legal person nº 513 950 940, with the share capital of 5.000 € (euros), hereinafter referred to as Garrafeira Gato Preto.

1.2 The purchase of any product at Garrafeira Gato Preto's Online Store implies acceptance of these General Terms and Conditions of Sale.

1.3 Any and all alcoholic beverages available for sale at Garrafeira Gato's Online Store Black can only be purchased by people of legal age, in their country of residence. It is assumed that the user when making the payment fulfills this legal requirement.

2. Product, Pricing and Content Information

2.1 Wines contain sulfites . Any additional information about any product for sale on the website, can and should be addressed to representatives through the contact forms. We will be happy to provide technical files, photos, or other information that the customer deems necessary for the best possible purchase.

2.2 Garrafeira Gato Preto reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on: products, prices, promotions, commercial conditions and services.

2.3 The images that illustrate each product in Garrafeira Gato Preto may differ from the product subsequently delivered. In case of doubt, the information contained in the article description prevails and not the photograph information.

2.4 Due to the stock turnover between our physical and online stores, unexpected stock outages in some products may arise . In these cases, the customer will be immediately contacted by Garrafeira Gato Preto in order to find the most suitable solution.

2.5 Despite Garrafeira Gato Preto's efforts, some products may show lapses, omissions or jackdaws, which is why we check all product information whenever we process orders. Consequently, the prices presented in www.garrafeiragatopreto.pt are merely indicative and do not constitute a contractual proposal. If the effective price of the product is lower than the advertised price, Garrafeira Gato Preto will refund the difference. If the price is higher, Garrafeira Gato Preto will inform the customer of this situation by e-mail and wait for their decision to accept the new price or cancel the order within 15 days from the date the e- mail.

2.6 Under Portuguese law, all prices shown at www.garrafeiragatopreto.pt include taxes at the legal rates in force, unless otherwise specified.

2.7 Promotions published at www.garrafeiragatopreto.pt may not apply to physical stores.

3. Order and Payment

3.1 After order confirmation at www.garrafeiragatopreto.pt , an email will be sent to the contact address registered by the customer at the time of formalization, with all details about delivery, billing, payment information, products and values. Garrafeira Gato Preto suggests to all customers the confirmation of its details. If the customer does not receive the order confirmation email, he is asked to contact Garrafeira Gato Preto through our contacts so that this notification is sent again to the email address of the customer.

3.2 If any of the details placed by the customer in the order are incorrect and the customer wants to change them, you can do so, as long as the order has not yet been shipped. In that case, the customer is requested to contact as soon as possible so that the requested change can be made internally. Changes to the details of orders already shipped will have to be analyzed by the Garrafeira Gato Preto team so that, together with the customer, a more appropriate solution can be found.

3.3 All orders in Garrafeira Gato Preto will only be processed after effective receipt of payment. The formalization of the order alone does not constitute a product reservation.

3.4 If an order cannot be satisfied in part or in whole, the customer will be immediately contacted by Garrafeira Gato Preto in order to find the solution most appropriate.

3.5 All orders placed at Garrafeira Gato Preto have a maximum payment period of 3 days. After this period, the order will be automatically canceled.

3.6 Orders can be canceled when expressly requested by the customer through one of our contacts, before shipments of orders. After confirming the shipment of the order, the customer is asked to contact Garrafeira Gato Preto so that, together with it, the most appropriate solution can be found.

3.7 Through the Garrafeira Gato Preto Online Store are accepted payments via MBWAY (both for customers with a bank account in Portugal), Bank Transfer, Credit Cards and Paypal.

3.8 The order status at Garrafeira Gato Preto is comprised of 3 phases: Pending, In Processing and Finished.

a) Pending - Awaiting payment or stock replenishment.
b) In Processing - The order is in preparation / preparation;
c) Finished - The order already has been sent / sent.

3.9 Payments are received in euros, regardless of the currency in which the transaction is made, the conversion rates for payments made in other currencies must be borne by the customer.

4. Shipping costs

4.1 The prices shown on the products are increased by the respective shipping costs, for each order, which are calculated based on the sum of two factors: the cost of packaging and the cost of transport. The cost of packaging for each bottle is 2 € (euros). The shipping cost depends on the weight of the order and the respective delivery destination. This shipping cost can be simulated inside the shopping cart with the desired products added and filling all the requested fields of the simulator. The total postage will also be automatically calculated when placing your order in the Online Store. Please note that the factors in this calculation may vary and change without notice.

5. Shipments and Deliveries / Pick-up at a Physical Store Garrafeira Gato Preto

5.1 For orders to be sent to the requested address, the shipping option must be chosen - National Shipping (in the case of Portugal) and International Shipping (in the case of other countries outside Portugal).

5.2 In normal conditions , after dispatch, an order at Garrafeira Gato Preto takes delivery:

- 3 working days in mainland Portugal;
- Between 5 to 9 working days in Madeira and Azores Islands;
- About 6 working days in the rest of Europe;
- Approximately 7 working days in the rest of the world.

5.3 After the orders are dispatched, the information for monitoring the shipment will be available in the account of customers who have placed the order with registration and a notification is also sent via e-mail with the link information for monitoring the shipment to all registered and unregistered customers. If for any reason the customer does not receive the shipping confirmation, he must contact Garrafeira Gato Preto through one of our contacts so that all available information about the order's dispatch will be sent again. < / p>

5.4 After the notification of dispatch, customers should follow the status of the shipment through the link provided by Garrafeira Gato Preto, so that they are aware of the state of evolution until the time of delivery of the order, since Garrafeira Gato Preto does not notify every change in shipping status.

5.5 All products sent by Garrafeira Gato Preto must be checked upon delivery. If the customer finds that the order is damaged, he must immediately return it to the transport company, duly justify the reason for the return on the carrier's delivery note and immediately notify Garrafeira Gato Preto through one of our contacts. < / p>

5.6 If, after delivery, the customer finds that any of the items is not in conformity, he is asked to immediately contact Garrafeira Gato Preto through our form , indicating the order number, attaching images of the package as received and of all articles, so that the investigation of the occurrence and in this way the situation can be resolved as soon as possible.

5.7 Garrafeira Gato Preto is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. It is the customers' responsibility to seize the respective orders, as well as to pay customs fees, if any. In case of return of the products Garrafeira Gato Preto will refund only the respective amount for these same products. In case of doubts the customer can contact Garrafeira Gato Preto before ordering.

5.8 Garrafeira Gato Preto has contracted services with specialized carriers for the purposes of deliveries in Portugal, Europe and most countries in the world. Every effort is made to meet the shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be alien to Garrafeira Gato Preto, and it is not possible, in these cases, to guarantee exact delivery times.

5.9 Most deliveries are made during business hours on working days at the shipping address indicated by the customer when submitting the order.

5.10 In case of delivery attempt by the shipping company unsuccessful transport due to absence, a transit notice is always left in the customer's mailbox with the carrier's instructions. Depending on the service and the carrier, orders must be collected at the location indicated by the same in the passage notice, or the indications requested in the same notice must be followed.

5.11 If for any reason the customer cannot receive the order or pick it up at the location indicated by the carrier, the customer is asked to contact Garrafeira Gato Preto so that together they can find the most suitable solution.

5.12 Before submitting the order, if the customer wants to pick it up at one of our Stores, he must select the '' Pickup at the Store '' shipping option - the Garrafeira Gato Preto Store will be automatically taken over at Avenida João Franco, nº 308 - 5050-226 Peso da Régua.

a) Only the person whose name is described on the order form will be authorized to pick up the order, unless the person informs Garrafeira Gato Preto in advance that someone else (identifying the name) will pick up the order.
b) Orders for pickup in the store must be collected after notification via email or phone, when they are completed.
c) When going to the premises of Garrafeira Ga to Preto, the customer must accompany the email or sms mentioned in the previous paragraph and thus avoid unnecessary travel.

6. Exchanges and Returns

6.1 Garrafeira Gato Preto recognizes to all its customers the right to terminate the contracts they conclude, allowing them to return, within 14 (fourteen) days, of the products purchased pursuant to Decree-Law No. 143/2001 and Decree-Law 82/2008 of 20/05.

6.2 For exchanges or returns, the customer is requested to contact Garrafeira Gato Preto by e-mail gatopretowinehouse@zonmail.pt indicating the order number, taking into account the conditions described below in the following topics:

a) In order to return the order, the product must be in perfect condition, and if applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.
b ) The return of defective products and erroneous shipments will be admitted, Garrafeira Gato Preto being responsible for shipping and collection costs whenever the customer communicates this circumstance within 14 (fourteen) days from the date of receipt of the product.
c) Once the goods have been received at our facilities and after validating their status accordingly, the value will be returned according to the method of payment made by the customer, or another solution previously agreed with the same.

6.3 Garrafeira Gato Preto assumes the responsibility arising from defects of origin or raw material of the purchased product and, if confirmed by the specialized team of Garrafeira Gato Preto, as well as the producer or oenologist, the product will be exchanged or returned at no cost to the customer.

6.4 Garrafeira Gato Preto will not accept return of the product after being used, or if it has been altered or modified.

6.5 Garrafeira Gato Preto is not responsible for deficiencies resulting from incorrect use, negligence, poor storage conditions or causes of force majeure.

7. Applicable Law

7.1 All purchases made on the garrafeiragatopreto.pt website are subject to Portuguese law. Any conflict or divergence in the interpretation of the General Conditions of Sale Online will be submitted to the competent Portuguese Court.

7.2 If the Client is outside of Mainland Portugal, Garrafeira Gato Preto informs that any judicial process must be exclusively established in the Portuguese Courts.
